A class action lawsuit is a claim where a group of people who are “similarly situated” collectively bring a complaint before the court. The courts have procedural rules that allow for a class to be certified. The group must have similar injuries and shared circumstances that raise the legal issue and the court must decide if it burdensome or impracticable to bring separate lawsuits. If the court agrees then it will certify a class of plaintiffs. If a class is not certified then the individuals may still bring an individual lawsuit to enforce their claims. An individual who received unsolicited texts messages can join in a potential class or may opt to bring an individual action. Please note that you are not considered a client until you have signed a retainer agreement and your case has been accepted by us.
